1 INTRODUCTION
1.1 These Terms and Conditions regulate the sale, including registration, of MYVALENTINA products via the website www.myvalentina.store.
1.2 The website www.myvalentina.store is managed by the company Maria Joana Silva Moreira, NIF 222032650, Avenida D. Afonso Henriques 1196 in Matosinhos.
1.3 For the purposes of these Terms and Conditions, the following definitions shall apply
a) - “MYVALENTINA” - Products commercialised on the website www.myvalentina.store;
b) - “User” - Any natural person, not a trader, who places an order via the website www.myvalentina.store;
1.4 The use of the website www.myvalentina.store and the purchase of MYVALENTINA products presupposes the User's knowledge, understanding and acceptance of these Terms and Conditions.
2. REGISTERING ON THE WEBSITE
2.1 To place an order, the User may first register by filling in the fields on the form on the website www.myvalentina.store. It is also possible to place an order without prior registration.
2.2 From the moment you access your personal account, you are subject to these Terms and Conditions.
3. MY Valentina PRODUCTS
3.1 The website www.myvalentina.store is aimed at all users who wish to purchase MYVALENTINA products from their home or workplace, 24 hours a day, 7 days a week.
3.2 Information on product characteristics can be found at www.myvalentina.store.
3.3 MYVALENTINA reserves the right to modify, at any time, the information, product offer, prices, promotions and commercial conditions presented on the website www.myvalentina.store.
4. PLACING ORDERS ON THE WEBSITE
4.1 In order to order at www.myvalentina.store, the User must have an e-mail account and their browser must be configured to accept cookies and pop-ups, which will allow them to enjoy all the navigability conditions of the MYVALENTINA online shop.
4.1.1 The User may purchase products online, provided that:
a) Find the product(s) you want to buy;
b) Add the selected product(s) to the “Shopping Basket”;
c) Register the User's personal data, which will be included in MYVALENTINA's database under the terms of the Privacy Policy, including the “Delivery Address”, “Billing Address”, “Payment Method”, telephone number and tax identification number (TIN);
d) Review your order and confirm it;
4.2 The User will receive an order confirmation e-mail with details of the payment method they have selected.
4.3 Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process and with the corresponding itemised invoice.
4.4 By submitting the order form, the User accepts the Terms and Conditions of purchase described at www.myvalentina.store, as well as the Privacy Policy.
4.5 MYVALENTINA reserves the right not to accept and to cancel orders already confirmed in the following situations:
a) The product is not available;
b) Payment is not made using any of the payment options available on the website www.myvalentina.store;
c) Payment is not confirmed;
d) The billing information is not correct or verifiable;
e) There is an error in the price quotation;
f) It is not possible to deliver to the address provided by the User.
5. PRICES
5.1 The prices of the products displayed on the www.myvalentina.store website include Value Added Tax (VAT). The total VAT payable by the User will be indicated on the invoice to be sent to the User.
5.2 All prices are quoted in euros (€). Please note that changing the country of delivery may affect prices due to different transport costs. Customs costs relating to the country of delivery of the order will be borne by the customer.
5.3 The prices of the products shown on the website are subject to change. MYVALENTINA reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
5.4 If there is an error in the price of the products ordered, MYVALENTINA or the User may cancel the order until the order has been dispatched.
5.5 The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.
5.6 The User shall only pay the amount specified in the order confirmation.
6. PAYMENT METHODS
6.1 Users may pay for their purchases via :
MBWAY, Multibanco Reference , Multibanco Transfer, Visa
6.2 MYVALENTINA does not accept any payment method other than those mentioned in the previous point. The User must not attempt to pay by any means other than those listed in the specified payment methods. If you do so, we cannot be held responsible for loss of payment or any other damage that may result.
7. SHIPPING COSTS
7.1 Shipping to Portugal costs €4.80
7.2 Outside Europe, all orders will have an associated shipping cost (19€) which may require the payment of customs costs, depending on the country of delivery (at the customer's expense).
8. DELIVERY
8.1 MYVALENTINA will send the product(s) ordered by the User from Monday to Friday, from 11 a.m. to 5 p.m., with the exception of public holidays, and on the days and times used by the logistics company, to the delivery address indicated by the User.
8.2 Our delivery service does not include an appointment option, so the parcel will be delivered without prior contact by the carrier, and it is necessary to ensure that someone is at the delivery address.
8.3 Delivery times in Portugal vary between 1-5 working days depending on the item ordered. MYVALENTINA's ability to respond within these deadlines varies depending on stock availability, as well as during periods of promotions, sales and Christmas.
8.4 MYVALENTINA will inform the User of the unavailability of the product(s) ordered, as well as refund the amount paid, within a maximum period of 15 (fifteen) days from knowledge of the unavailability.
8.5 If the carrier is unable to deliver the products on the date indicated, the User will be contacted in order to be given another delivery date.
8.6 Upon delivery, the User must inspect the packaging for any damage. If they find that the products are damaged, the User must not accept delivery of the order, which will be returned. The User should report the situation, if possible documented with photographs, by emailing myvalentinabyjoaninhas@gmail.com and if they agree, MYVALENTINA will resend the order at no cost to the User. If the User wishes to cancel the order, the full amount paid will be refunded.
8.7 If you do not receive your order within a maximum of 90 (ninety) days from the date of payment, please send an e-mail to myvalentinabyjoaninhas@gmail.com informing us of this. After this period, MYVALENTINA cannot be held responsible for the loss of the parcel.
8.8 Delivery is deemed to have taken place with the signature on the delivery receipt at the agreed address.
9. RIGHT OF WITHDRAWAL
9.1 The User may withdraw from the contract up to 14 (Fourteen) days after receipt of the order, provided that:
a) The product(s) have not been used;
b) The product(s) retain their original characteristics and labels intact;
c) The product(s) are complete. All material accompanying orders must be returned.
9.2 The User may exercise their right of withdrawal by sending the withdrawal form or any other unequivocal declaration of withdrawal from the contract to the e-mail address myvalentinabyjoaninhas@gmail.com .
9.3 The cost of returning the order when exercising the right of withdrawal shall be borne by the customer.
9.4 When the postage offer is applied, if the customer wishes to return the goods, they will be charged the same (€4.80).
9.5 In the event of a return, an administrative fee of €1.70 (VAT included) will apply. However, if the customer prefers to return a voucher for later use, the fee will not be charged. In these cases, a voucher will be issued with the respective value for use on future purchases. The value of the voucher will only relate to the cost of the product(s) and not the respective shipping costs.
9.6 Once MYVALENTINA has received the returned product, it will analyse and confirm the condition of the order and, where applicable, refund within a maximum period of 15 (fifteen) days the amounts paid by the User in the order, using the same means used to pay for the order.
9.7 If the items returned show signs of use, MYVALENTINA reserves the right not to accept the return and to refuse to refund them.
9.8 Users should note that if their return has been made for reasons other than the justified existence of a defect or non-conformity of the products ordered, MYVALNTINA will not reimburse the shipping costs. In other words, MYVALENTINA will not reimburse the shipping costs initially borne by the customer for the order.
9.9 Please note that these conditions only apply to orders placed in Portugal. If your order has been placed outside Portugal, please contact us at myvalentinabyjoaninhas@gmail.com .
10. CANCELLATIONS AND RETURNS
10.3 If the order has been received after dispatch, the rules set out in the previous chapter on the right of withdrawal shall apply.
10.4 MYVALENTINA does not offer direct exchanges. The User may opt for a voucher to exchange their order for another item available on the website, at their own expense. Please note that orders placed with a voucher and subsequently returned can only receive a new voucher as a refund.
10.5 In the event that the product ordered is defective or otherwise non-conforming, the User may choose:
a) replace the product;
b) terminate the contract.
10.6 As soon as the User notices a defect or other non-conformity of the product, they must notify us by e-mail to myvalentinabyjoaninhas@gmail.com, sending supporting photographs.
10.7 As soon as we receive your e-mail, we will contact you to resolve the problem consensually.
10.8 In any of the options exercised by the User pursuant to 10.6, the respective costs shall always be borne by MYVALENTINA.
10.9 We do not make returns on sale items. Exchanges only.
10.10 We do not accept returns on orders placed for in-store pick-up. Only exchanges.
10.11 We do not make returns on swimwear products (bikinis), we only exchange sizes.
10.12 We do not exchange or return party items.
10.13 We do not exchange or return accessories.
11. QUALITY
MYVALENTINA does not sell second-hand, defective or substandard products. The main characteristics of each product shown on www.myvalentina.store can be found on each product page.
MYVALENTINA will make every effort to ensure that the colours of the products that appear on the www.myvalentina.store website are as accurate and real as possible. However, as computer monitors vary, we cannot guarantee that your monitor is displaying the exact colours.
12. COMPLAINTS
With a view to continually improving the services provided, MYVALENTINA will endeavour to respond to and resolve any complaints submitted by the User within 5 (five) working days, by emailing myvalentinabyjoaninhas@gmail.com.
13. WARRANTY AND AFTER-SALES SERVICE
MYVALENTINA products benefit from the guarantee of conformity provided for in the legislation applicable to the sale of consumer goods.
14. EXCLUSION AND LIMITATION OF LIABILITY
MYVALENTINA does not guarantee the uninterrupted operation of the website www.myvalentina.store, or any of its functionalities, which may be suspended for maintenance, repair or updating.
Likewise, MYVALENTINA shall not be liable for any damages arising directly or indirectly from force majeure situations that prevent MYVALENTINA in any way from fulfilling its obligations, such as strikes, failures in the electricity grid, telecommunications services or any other services, fires, floods, inability to obtain products, materials or services, breakdowns, delays by suppliers or carriers and changes in legislation or administrative regulations.
MYVALENTINA shall not be held liable for any misuse of the User's access data to the website by third parties, given that it is personal and non-transferable.
15. MODIFICATION OF TERMS AND CONDITIONS
MYVALENTINA reserves the right to amend these Terms and Conditions at any time, and the amendments will be deemed to have been made and users notified by publishing the amended Terms and Conditions on the website www.myvalentina.store.
16. PROCESSING OF PERSONAL DATA
Please read our Privacy Policy carefully so that you are aware of the rules and procedures adopted by MYVALENTINA with regard to the processing of data collected when you browse the website www.myvalentina.store and when you use the functionalities it offers, as well as the applicable security and confidentiality measures.
17. PROOF AND ARCHIVE
The computer records, kept by MYVALENTINA in secure conditions, are considered as proof of the communications, orders and payments made between MYVALENTINA and the User.
18. APPLICABLE LAW
These Terms and Conditions and all disputes arising in connection with them, including their validity, the use of the website or any purchase on it shall be governed by Portuguese law.
